THE Guernsey Bar has developed a website informing islanders about mediation as an alternative to litigation when in dispute.
The website (www.mediationguernsey.com) has been devised by the Guernsey’s Citizens Advice Bureau with input from legal experts from the Guernsey Bar and the hope is those in dispute will turn to mediation for both family and commercial issues.
Mediation, a form of alternative dispute resolution, involves a third party that assists in negotiations with the aim of reaching a settlement.
Commercial mediation is intended to assist in the resolution of civil disputes ranging from breaches of contract, damages for injury, neighbour disputes and defective goods. Contracts can sometimes include an enforceable provision that any dispute must be mediated before going to court.
Family mediation typically involves divorce and access to children.
Bâtonnier Mark Helyar, also a trained mediator, said there were many benefits to mediation including a lower cost than litigation, confidentiality and the support and advice received from a trained mediator.
”The website aims to demonstrate how mediation is a viable alternative to litigation. As long as both parties are realistic and willing to communicate then mediation can be the fastest and cheapest option in a dispute.
“In the case of family disputes it can help avoid the stress often associated with formal court procedures,” said Mr Helyar.
